Blue Card refused in Germany: does § 81(4) AufenthG still protect you?

🇩🇪 DE · permits · 2026-10-10
Translating to Swedish. Showing the English original for now.

If you applied for an EU Blue Card or another residence permit before your current permit ran out, section 81(4) of the Residence Act (AufenthG) keeps your old permit alive, but only on its old terms and only until the immigration office (Ausländerbehörde) decides. It does not give you a new right to work in the job you applied for. A refusal by the Federal Employment Agency (BA) is a step inside the procedure, and moving to another city usually means a different office now handles your file. Once a formal refusal is served, you normally have one month to challenge it, but the challenge alone does not restore your right to stay. This is general information, not legal advice.

What section 81(4) AufenthG actually protects

In plain English: if you apply to extend your permit, or for a different permit, before your current one expires, your existing permit counts as continuing from its expiry date until the immigration office decides. This continuing effect is called Fortgeltungsfiktion or Fiktionswirkung.

Three details matter:

  • It is the old permit that continues. If your old permit was a national visa for an internship, what continues is that internship visa, with the work it allowed and nothing more.
  • It ends with the decision of the Ausländerbehörde. The law ties the end point to the decision of the immigration office, not to an internal opinion from another agency.
  • It does not apply to Schengen visas. Section 81(4) says: "Dies gilt nicht für ein Visum nach § 6 Absatz 1." Section 6(1) covers Schengen short-stay visas. A national visa for longer stays falls under section 6(3) and is not excluded.

If you applied late, section 81(4) adds that the office "kann" (may) order the continuing effect to avoid unfair hardship. That is a discretionary decision, not an automatic right.

The Fiktionsbescheinigung: proof, not a permit

Section 81(5) says: "Dem Ausländer ist eine Bescheinigung über die Wirkung seiner Antragstellung (Fiktionsbescheinigung) auszustellen." The office must give you a certificate showing the effect of your application.

The certificate documents a status you already have under section 81(4). It does not create one. Employers and landlords ask for it because an expired visa alone does not show lawful residence. If your application was made in time and is still open, ask the office now handling your file for this certificate in writing, and keep copies of the request and of your original application receipt.

Can you keep working while the application is open?

Section 4a(3) AufenthG says that if a permit was issued for a specific employment, any other work is forbidden until the authority allows it: "ist die Ausübung einer anderen Erwerbstätigkeit verboten, solange und soweit die zuständige Behörde die Ausübung der anderen Erwerbstätigkeit nicht erlaubt hat."

Because section 81(4) only continues the old permit, the work allowed during the fiction period is the work the old permit allowed. A new full-time job that needs the Blue Card is not covered by an internship visa. Section 4a(3) also governs changing jobs on a German residence permit.

Section 81(5a) does allow the work described in the future permit, but only from a late point: "ab Veranlassung der Ausstellung bis zur Ausgabe des Dokuments." In plain English, from the moment the office orders the new card to be produced until you receive it. That is after approval, not while the application is still being examined.

So the honest answer to "may I keep working?" is: only within what your old permit allowed, unless the office has approved the new permit or allowed the work in writing. Raise this with HR now: section 4a(5) obliges employers to check that you hold a permit allowing the job.

What the BA refusal means for a Blue Card

For most Blue Cards, the immigration office decides without the BA. Section 18g(1) sentence 1 grants the card "ohne Zustimmung der Bundesagentur für Arbeit" if your salary reaches at least 50 percent of the annual contribution ceiling of the statutory pension insurance. The general rules are in the EU Blue Card in 2026.

A lower threshold of 45.3 percent applies to certain occupation groups listed in the law and to graduates whose degree is no more than three years old, but then the card is issued "mit Zustimmung der Bundesagentur für Arbeit", with BA approval. Graduates on the job-seeker permit can read switching to a Blue Card early.

Section 39(2) sets what the BA checks. The first condition is that you are "nicht zu ungünstigeren Arbeitsbedingungen als vergleichbare inländische Arbeitnehmer beschäftigt", not employed on worse terms than comparable local employees. So when BA approval is needed, meeting the statutory minimum is not enough on its own: the BA also compares your terms with local pay for the same job.

There are two practical routes. Either the employer changes the terms (salary, or a job description that honestly matches the role) and you submit the updated contract, or the salary reaches the 50 percent level so that BA approval is not needed at all. A new title without a real change in duties is unlikely to help, since the comparison is with comparable employees.

Moving to another city during the procedure

Under the general rule of the federal Administrative Procedure Act (VwVfG), section 3(1) no. 3a, the competent office for a person is the one "in deren Bezirk die natürliche Person ihren gewöhnlichen Aufenthalt hat", where you habitually live. When you register your new address in a new city, competence usually moves with you.

Section 3(3) VwVfG allows the old office to finish the case only if that serves a simple procedure and the new office agrees. Otherwise the file goes to the new office. A transfer because you moved is not a refusal, but ask both offices to confirm in writing which one holds the application.

Deadlines once a refusal is served

A formal refusal (Ablehnungsbescheid) is the decision that ends the fiction period. From then on:

  • Objection. Section 70(1) VwGO: "Der Widerspruch ist innerhalb eines Monats, nachdem der Verwaltungsakt dem Beschwerten bekanntgegeben worden ist" to be filed with the authority that issued the decision. In plain English: within one month after you were notified.
  • No objection procedure in some cases. Section 68(1) VwGO allows a law to skip the objection stage. Your decision letter tells you which remedy applies.
  • Lawsuit. Section 74(1) VwGO: the action "muß innerhalb eines Monats nach Zustellung des Widerspruchsbescheids erhoben werden", and where no objection decision is needed, within one month of notification of the original decision.
  • Missing instructions. Section 58 VwGO: the deadline only starts if you were told in writing about the remedy, the authority or court, and the time limit. If that information was missing or wrong, the limit is one year.

Section 84(1) no. 1 AufenthG says objection and lawsuit against the refusal of a residence permit "haben keine aufschiebende Wirkung", no suspensive effect. Section 84(2) adds one point for work: for taking up or continuing employment, the permit counts as continuing while the deadline for objection or lawsuit is running and while a court is examining an urgent application to restore suspensive effect.

After a refusal, section 50(1) makes you obliged to leave if you no longer hold a required permit, and section 59(1) says removal is announced with a period of between seven and 30 days for voluntary departure.

Country specifics: Berlin and Brandenburg

In Berlin the immigration office is the Landesamt für Einwanderung (LEA); in Brandenburg each district has its own Ausländerbehörde. Send important statements in a form you can prove and keep every confirmation.

FAQ

Does a BA refusal end my Fiktionswirkung?

Section 81(4) ties the end of the fiction to the decision of the immigration office. Ask the office now handling your file to confirm in writing whether a decision has been issued.

My old office closed the file because I moved. Is that a refusal?

A transfer because of a change of address is a question of competence under section 3 VwVfG. Get written confirmation of which office holds your application.

Can I work in my new job on a Fiktionsbescheinigung?

Only within what your old permit allowed, unless the office has approved the new permit or given written permission (sections 4a(3) and 81(5a) AufenthG).

How long do I have to object to a refusal?

One month from notification (section 70 VwGO), or one month to sue where no objection procedure applies (section 74 VwGO). Without correct written instructions, one year (section 58 VwGO).

Does an objection let me stay?

Generally no. Section 84(1) AufenthG gives it no suspensive effect, although section 84(2) keeps the permit valid for work purposes while the deadline runs.

Will a higher salary fix a BA refusal?

At 50 percent of the pension contribution ceiling, section 18g(1) sentence 1 issues the Blue Card without BA approval.

How Jobsy fits

We build Jobsy, a job search service for Europe: you say what work you want, and Jobsy finds employers and recruitment agencies in Germany and five other countries, from a base of more than 2.6 million employers and recruitment and staffing agencies, and prepares personal messages in the recipient's language. It cannot fix a permit or speed up an immigration office. If your current offer falls through and you need employers who can meet Blue Card terms, the first result is free, and Jobsy Active, which keeps the search going, costs €6.70 a month.
